Did a San Francisco jury get it right? One just convicted a mother who threw her 6 year old, 2 year old and 16 month old into San Francisco Bay. Her lawyers put on some variation of an insanity defense, claiming that the convicted mother truly believe she was sending her children to heaven by drowning them. I have a hard time with this type of defense here because I can't take my mind off of the helplessness of these poor children. What a sickening tragedy.

Yeah, I'm usually not compelled by the insanity defense. First, I don't think it's too controversial to claim that we don't always care what state of mind someone is in when they commit a crime; punishment might be in order simply based on consequences. Besides this, what sort of justification is insanity anyhow? It's not so much a justification as an excuse for not having to provide one.

Exactly...I'm a big believer in people treating for their problems before they hurt others. Of course, there are probably situations where lose control but as a general rule, get help first, especially when you take on the responsibility of becoming a  parent (everything you do matters). I'm sure this comment will piss off a bunch of criminal defense lawyers and I welcome their responses.
